Online Retailer Scam

I bought shoes from the vendor which I received and realized they did not fit. I mailed the shoes back, when the mailed package was opened at the vendor warehouse the shoes were taken out of the shoebox - thus they denied my refund. I contacted them to understand what had happened, as I did everything I was supposed to do when returning the shoes. It has been 3 months and the vendor has done nothing to help resolve this situation, every time I call they say they will escalate the issue but no progress has been made. I have called them 10+ times over the past 3 months and spent over 10hrs on the phone. Thus, I decided to create a claim with UPS, the shipping company. UPS reviewed the claim, resolved the claim and notified the vendor. Since the vendor is technically the shipper, since they created the return label, they are being paid the amount by UPS for the package, not me. The vendor still is refusing to issue my refund even though they have gotten a payment from UPS for the claim that I created. Vendor is denying my refund and collecting claim money from UPS.
