FAKE DEBT COLLECTOR! They know literally everything…social security number, bank account number, vehicle information, previous and current addresses, family member names, literally everything. Posed as a debt collector for a payday loan from 5 years ago. I didn’t remember the business they claimed I took the loan through so I contacted them. They emailed back that they did not have my name anywhere in their database and do not give loans but connect customers to lenders. Refused to give me a corporate number or address, and hung up on me 7 times when I asked for this information. Then told me they were going to report me for harassment. Said there would be an officer serving me a court summons by Friday at my job or home, and subpoena my sister as a witness. Originally told me I owed over $900 for this alleged $500 payday loan, and dropped the amount to $500 really fast when I started asking probing questions. Called me from (502) 684-8582, called my father from 912-406-0995, and the phone number listed on the PDF they sent me is 980-222-2930, the address listed is 7209 E. WT Harris Blvd Ste J #112, Charlotte, NC 28227 (which is a UPS store), and the website is http://1stpointsolutions.com/.

First off relax!
Secondly: They try and collect uncollectible debts that the original creditor eventually gave up on probably years ago.
Thirdly: Debt collectors buy these debts for pennies on the dollars.
Fourth: In California the SOL is 4 years. If the debt is older than that the debt collector cannot bring suit no matter where the creditor is located.

The statute of limitations on debt in California is four years, as stated in the state's Code of Civil Procedure § 337, with the clock starting to tick as soon as you miss a payment. Some debt collectors try to restart the clock by misrepresentation. That is to say the date of default (first missed payment) is now the date they purchased the debt from the original creditor.

Long story short check your state's SOL before you panic! Once the SOL has passed they can not sue!

Another Tip: Legitimate Creditors will not tell you when and where they are going to serve you. First they make multiple calls, then they send a collection letter or two (dunning letters) and extend various offers to "settle" your debt. If you fail to pay or !ake arrangements to settle the outstanding balance then they will file a civil complaint with your local superior court. Once filed the complaint must be "personally" served only to you and no one else and that is why they don't tell you in advance when you are going to be served! Forewarned is forearmed! They don't want you dodging service because if they can't prove proof of service, that they actually served you, then the case gets dismissed for lack of service.

Debt collectors have a certain number of years they can sue you and win to collect a debt. It's called the statute of limitations and it usually begins when you fail to make a payment on a debt.
