A contract was signed on 05/12/2023 for construction of a permitted pergola/patio cover with Pronto Patio Cover Services. Per company work was to commence within a few days. After 20 days of no contact or work started we reached out to cancel services. Contract stated work was to start within 20 days. Owner stated it could not be canceled because they had already began work by filing a permit with the city. I emailed the city to verify permit was filed. They confirmed that permit was actually filed on 20th day 06/01/2023. Per copy of receipt provided they filed and paid for a permit about an hour or so after we made contact that same morning of 06/01/2023. She then stated that she didn’t know why city stated it was filed 06/01/2023. When asked to furnish copies of documents from city she only provided the receipt dated 06/01/2023 with a city letterhead. All other documents furnished were not from city. On 30th day from date of contract we reached out again, since no work had yet to begin. She then stated that work that was initially agreed upon could not be completed as city required a 12 foot setback from property line vs the 5 feet we had agreed upon. She never advised us prior to this of city requirement. She then refused to refund our full deposit claiming they needed to bill for all of the services provided so far. She stated she could only refund $400 of the $1000 claiming they needed to bill for services and time. When an invoice was requested they listed and billed for services provided prior to 06/01/2023 and or services like engineering costs, services fees and transportation. This items were never agreed upon as part of the cost and contract states there was no service fee for permits. Therefore, those items were never specified in contract or agreed upon. There was no breakdown or invoices provided of specific items billed, other than permit fee of $112.68. They then mailed out a bad check of $400 as a refund, the check was returned by the bank due insufficient funds available. She now claims it’s an issue with our bank. I have emailed to 2 emails listed for her and messaged her via text regarding invoice, amount of refund, and returned check but received no response.
At this point I feel that we have scammed out of the deposit provided in good faith. Linda Daniels Rodriguez clearly has not been honest and scammed us out of $1000 deposit in cash. No work was ever done at our property and all contact since signing contract has been initiated by us trying to get answers from her.
