Gowen vs Palmetto Solar, LLC
John Silas Berry came to our front door on Friday, October 6, 2023, representing himself as an employee of Palmetto Solar out of St. Petersburgh, FL. He said he had grown up in Sebring, FL and currently was residing in "St. Pete". He appeared to be in his middle twenties, white, medium build, fit, brown hair and eyes, not taller than 6 ft., very clean cut. He drove a dark Jetta a few years old. We sat down on our lanai and he proceeded to inform us about solar and the benefits of having them. He misled us into thinking they would be installed with no cost to us. He asked for a driver's license, DD14 (veteran certificate), phone number, address and email. This was provided as requested. He sent a text with a link and asked my wife to click on it and download their "monitoring" app, which she did. There was also an app for electronically signing a document he said he needed. The document was 42 pages long and small print. After I signed the document, he left and said the installer would be in touch and we had up to 10 days to cancel. That evening my wife did some research discovering the document I had signed was a monthly lease for a solar panel system to span 25 years for a total fee of over $70,000. At no time did "Silas" say the document he sent us for signature was a lease, nor that there was any cost to us for installation. Unfortunately, I believed what he told me and did not actually read the electronic document. The companies named on the document were Palmetto Solar, LLC dba LightReach. The installer was named as Vision Solar. Emails: [email protected] and [email protected]. We tried to reach out via email that Friday, but the first shot back an automated email stating they would get in touch during "business hours". The second email was returned undeliverable. Saturday, October 7th, we found two physical addresses in the contract - Palmetto Solar, LLC dba LightReach, 977 Morrison Drive, Suite 200, Charleston, SC 29403 and Vision Solar, 501 East Black Horse Pike, Blackwood, NJ 08012. When trying to send the cancellation via certified and return receipt at the local Post Office, we were informed the second physical address was not valid. I found a phone number in my recents on my iPhone where Palmetto Solar had reached out to me to set up this initial meeting with a sales representative and to let me know when he was on my property 813-536-5139. We called that number on Friday, October 6, 2023, and reached a representative, Matt. He passed me on to his supervisor, Macey, who then said someone would be contacting me. We called the number again on Saturday, October 7, 2023 at 11:45 AM and spoke with a customer concierge manager, Macey, and she passed me on to someone in another department, Alissa. I was then received an email on Monday, October 9, 2023 from a Suzette Maldonado, Customer Success Supervisor [email protected] | 717-251-1287 and informed to keep her contact information and that she would be in touch. I called the number and got a recording. Suzette called back and said she would send our information to a "proper team", but after much prodding said it would be their CEO. We feel like we are being kicked down the road in an effort to use up the 10 day cancellation grace period and are not processing our written confirmation.
We did some research in the past few days on Vision Solar and to our dismay there are hundreds of complaints about this company on ScamPulse.com and an internet search brought up multiple lawsuits alleging many deceptive practices. We are very distraught over the whole experience. We did not set up the autopay app as Silas instructed us to, and hopefully, that will keep them from withdrawing funds from my accounts. I do have documentation of the emails and letters going back and forth and feel strongly that will satisfy any written notification requirement, but you never know since we were lied to repeatedly.
