My father keeps getting emails and text from Steve Mitchell at Barkley & Mann, stating that his car was going to and bank accounts were going to be seized. No communication from Steve from Barkley & Mann has included what debt they are collecting for and the amount they are try to collect. I have also checked county court records and there are judgements for bad debt in either of my parents names for a collection agency to be trying to collect on. The first email he received was 'Your bank just acknowledged receipt of our request to freeze and attach your bank accounts. It will typically take effect in 5-7 business days depending upon how quickly your bank bank processed it. Also, I just emailed our enforcement team to let them know you never showed an interest in scheduling a time for them to arrive so I instructed them to go ahead and to arrive unannounced.' And the second email was. 'I just contacted Community Choice credit union to make them aware that we are enforcing liens per article 9 of the Uniform Commercial Code. Please remove your belongings from the 2019 Volvo as it is now scheduled to be picked up, if you prefer to surrender it, let me know and I'll provide you with a drop off location.' My mother also received a text stating that they were going to show up at their home and included their current home address to take their vehicle. I, their son and an employee of Community Choice C.U., confirmed with our collections and legal department no such notice was receive and no repo was ordered on their vehicle, as well as no one other than the sole lien hold on the title would be able to repo to vehicle. I have also received an email from this company for my father, several months ago, stating that he needed to contact them about a debt and the failure to do so could result in the seizure of property and bank accounts. I disregarded the email as it is spam, but now my father is worried that his vehicle and bank accounts are going to be taken because of the threatening tone of the emails and texts.
