In good faith, we shipped two containers of dried fruits to this company under a clear contractual agreement. The terms were simple and fair:
• 30% deposit before shipment,
• and the remaining 70% to be paid within 45 days after receiving the goods.
The total contract value was USD 184,757. However, after delivering the goods, we only received USD 27,000 over the course of three months. The balance — over USD 157,000 — remains unpaid.
In April, we personally traveled from Uzbekistan to Baku, spending thousands of dollars on flights, hotels, and related expenses in the hope of resolving the matter in person. The company representatives told us they were unable to sell the products. Out of respect and in the spirit of cooperation, we agreed to a USD 25,000 discount and signed a new agreement, giving them extended payment terms:
• USD 136,000 was due by April 20,
• and another USD 136,000 was to be paid by the end of May.
Yet again, these payment deadlines were completely ignored. We made a second trip to Baku in May, at an additional cost of USD 3,000, only to hear the same excuses — that they still had not sold the products.
We want to make this very clear:
Both contracts explicitly state that whether or not they manage to sell the goods has no effect on their obligation to pay. They accepted this condition and signed the agreements.
We even offered to take the products back, but they refused to cooperate. Instead, they insisted they are a large “holding” company — but what we witnessed was very different. They only have one small office, and while we were there, several other victims — also unpaid and misled — came seeking answers and their money.
This entire experience has been extremely damaging to our business. We trusted this company. We offered them credit. We gave them flexibility. In return, we’ve received broken promises, financial losses, and complete disregard for contractual and moral responsibility.
We are now left with no choice but to consider legal action and make the situation public if this is not resolved immediately. We urge this company to fulfill its financial obligations without further delay.
