When I asked Joe where the body shop was at he claimed it was at another location. He then proceeded to tell me that it would be better to get my car fixed at the dealership (Mercedes Benz). He then tried to talk me into obtaining a lawyer so that I could make a personal injury complaint. He explained that he had made a personal injury claim before and that he could tell me exactly what to say so that I could get paid. I told him I did not feel comfortable with doing that because I in fact was not hurt. I did not feel safe speaking to him anymore and asked him how much I owed him for towing my vehicle. He said that I did not owe him anything, he said he could tell I was a nice girl and that he just wanted to help me. I told him thanks but that it would be some days until my adjuster settled the liability because she was out of office. He said that’s fine when you figure it out with the insurance I’ll tow it to Mercedes Benz for you. At this point I still believed my car was undriveable so I agreed. 10 days later my insurance adjuster finally returns establishes liability and says that the other driver is denying being at fault. So until I go to mediation all of my expenses will be out of pocket. Immediately after learning this I reached out to Joe and asked how much it would be to tow my car to Mercedes Benz he said $500 dollars on top of the $5,000 you already owe me. I was baffled I questioned him and asked him why he felt I owed him so much. He then proceeded to tell me a bunch of charges which were miscellaneous and said he was charging me 255$ a day for storage. I told him I would have never left my car with him had I known he was charging me 255$ verbally he never expressed this nor did he say he would charge me to keep my car. I live in a private community I could keep my car at my personal garage. I never needed his services he continuously forced me to receive what I thought was help.
I called the non emergency police department but they said that in California towing companies are allowed to charge wat they want I also called the department of motor vehicles to see what I could do that is when I learned that Joe had called in to make a lean on my car not even within 10 days of my car being there.
When I told him I could not afford to pay him $5000 he said let me just talk to your insurance and you won’t have to pay anything. Again I did not feel comfortable with that. I had to ask my dad to talk to him and he was able to talk him down to $3000 dollars which is still outrageous. I’m a college student and my dad is a retired veteran we don’t have that kind of money.
From the beginning I should have just called my towing company thru my insurance but because Joe was there and made it seem like my car was not drive able I got scammed into a predatory towing situation.
I have recorded conversations with Joe where he explains the charges and you can hear him stumbling and making lies I also have a receipt which he claims I signed and I never did. I also have an invoice he made with charges that don’t even make sense.
Just to tow my vehicle to his “shop” alone was $1000 plus a $500 fee for damaged vehicle
I’m so hurt and distraught that someone could hold my car against me like that.
