Bob Miller (probably not his real name) called to offer our time share in Mexico for a price substantially higher than we had invested in it. He said he had a buyer, a Mexican national, who wanted to buy the unit for tax purposes. I smelled a rat, but went along to the next step, where Miller sent me an offer, and then a contract. Redacted versions of the contract is appended.

My investigation of the two outfits involved revealed the following:

US Federal Holdings, which also claimed to be in San Antonio, TX, now vanished, had this statement on their website:

• U.S. Federal Holdings manages over 3.3bn worth of property assets, works with over 380 resorts and leisure real estate developments and provides services to over 810,000 consumers worldwide. Our innovative approach combined with years of experience in business administration enables us to design perfect business solutions that are both manageable and cost effective. US Federal existed for one year, bilking the gullible before disappearing off the web

• This is identical wording as in Capital Federal Title Services (CFTS) web site and other scam web sites.

• Address of CFTS in Austin is J.J. Pickle Federal Building – which has only federal offices, and is thus BOGUS

• No listing for CFTS as Title Service company in Austin.

• No listing for CFTS in Texas Land Title Association, no for Anthony Ferguson as licenced agent/broker.

• State of Texas has no taxable entity named CFTS

• No ScamPulse.com listing for either CFTS or Brain Trust – unknown



• None of the signatories to the contract have a web presence - all names seem to have been taken from current or past sports figures, names obviously bogus.

• On the Brain Trust web site, paragraphs are lifted directly from other sites

• e.g. What do Slideshare, Pinterest, Airbnb, Behance, Posterous, Flickr, Etsy, Instagram, and Tumblr have in common? Well, they are all successful design-(co)-founded businesses. Their ‘design’ way of thinking transformed their startups into top companies with millions in revenue. But wait a minute, can their tremendous successes really be attributed to design? - exact wording found on LITTLE GUY DESIGN, web design site.

• The site contains no worthwhile information regarding the business of the company

• Brain Trust and two names associated with it are not listed with LARA – Department of Licencing and Regulatory affairs

• State of Michigan has no taxable entity named Brain Trust Marketing Group

• None of the individuals mentioned in the contract are members of Licensed Timeshare Resale Brokers Association, nor is anyone licenced in Texas or Michigan as a real estate broker.

Received a call from Dan Ortiz at "Brain Trust Marketing Group" out of Detroit, MI. telling me he has a buyer interested in my Mex timeshare. He asked me a few questions about it and later that day emailed me an "offer" for $47,000 purchase price. He said the deal takes 15 days to complete once a final price is decided upon etc.. I was already suspicious and the price offered made me even more so. His boss called me the next day. His name is "James Hensen". He asked me if I was able to get the paperwork faxed so we could move ahead. I looked at his company website and it is very vague....more red flags. I google-earthed the address and found it to be a high rise on the water in Detroit. His company address on the "letterhead" had no suite number. The building at 200 Renaissance Center has 37 floors. When I asked him for the suite number he stammered like he didn't know what I was asking and then said #107. I told him that I believe this to be a scam and to lose my number. He told me he will move a head until he finds a seller. Beware. He seems like a nice enough guy and not at all deterred. He had my phone number and my old email address. The one I would have given to the resort when I purchased the timeshare. I get at least one call a week from these type of scams and think its ridiculous that the timeshare resort has allowed our information to be public for any crook to use.
