- Litchfield Park, AZ, USA

The seller TVSmart placed a popup ad in YouTube. The ad made false claims. It was 100% false advertisement. It was fraudulent advertisement. The ad said that with their TV Stick, you could get access to premium channels for free and that it was 100% legal. Their website says it a little bit more vaguely, but the YouTube ad said it blatantly. The website says, "On-Demand Video Services on any TV, Without Monthly Fees", and "a compact, portable stick that connects to any TV, granting users access to a vast array of TV channels, movies and TV Shows without the need for multiple expensive subscriptions", and "The box is therefore 100% legal and without any risk". The seller TVSmart collects the payment using the name "EKOMM SOCIETY LTD". I paid $163.77 USD through PayPal to seller EKOMM SOCIETY LTD for a product that was falsely advertised. PayPal offers a Buyer Protection Program to reimburse buyers for eligible online purchases. This includes purchases where the item received is “Significantly Not as Described” from what the buyer ordered. However, PayPal's buyers protection does not help at all unless you do not receive the items. If you receive anything at all, you're screwed. The fact is that I was induced to order the items from TVSmart/EKOMM SOCIETY LTD because of their false advertisement on YouTube. I contacted PayPal and opened a case. PayPal escalated the case to a claim. The trick is that PayPal refuses to refund me my money unless I return the items to the seller in China at my own expense, which is very expensive. I don't mind returning the items to the seller AS LONG AS the seller pays for the return shipping costs because I would not have ordered the items except for seller TVSmart/EKOMM SOCIETY LTD's false advertising. It is the seller's fault that this transaction took place. Still, so far PayPal has refused to refund me my $163.77 USD.

More information:

The address that the seller gave for the return is:

First High-tech Industrial Park, Sandy Kong, Room 305, Building 109, No. 72, Luohu District, Shenzhen, GUANGDONG, CN, 518004.

The other website and email address used by this seller are these:

https://checkout.ekmshp.com/ and

[email protected].

Beware of this scam. Their TVSmart TV Stick product is very expensive, and it does not provide free access to premium channels. Besides, it works worse than a Roku because it is very slow, clumsy, and complicated.
