I received a suspicious email from Barry * ********, and found an almost identical complaint in your database. My sense is that it is a phishing scam:

This is our final effort to reach out to you regarding the official registration of the business name "XXXX". If we do not receive your confirmation for registration by the end of today, we will have to proceed with another applicant by tomorrow. This may lead to the loss of your right to use the business name "XXXX".

Our trademark registration procedures involve thorough assessments of search engines and social media platforms to ensure the uniqueness of the brand name. If we do not hear back from you within 24 to 48 business hours, we will move forward with the registration process for the interested party.

Trademark conflicts are viewed as breaches of civil regulations, potentially leading to a court-mandated halt in trademark utilization. Moreover, financial restitution might be necessary, entailing the forfeiture of profits acquired through unauthorized usage or the payment of monetary penalties. Consequences for trademark violation could also include injunctive measures or the issuance of a cease-and-desist directive.

Given your long-standing use of our brand, we understand that you may have the option to avoid legal action against the other party, especially if they are a startup. However, if you wish to claim ownership of the business name "XXXX," it is crucial that you respond promptly so that we can assist you in navigating the registration process.

Your immediate attention to this matter is appreciated, and we anticipate your expeditious response.

We received an email claiming they were going to give our registered trademark to another entity if we didn't respond to them by the end of the day. (We registered our trademark in 2007 and it was renewed in 2018 to be good through 2028.) This was followed by a paragraph of very threatening language as if we were doing something wrong and could be charged damages. Here is that paragraph: "Trademark conflicts are viewed as breaches of civil regulations, potentially leading to a court-mandated halt in trademark utilization. Moreover, financial restitution might be necessary, entailing the forfeiture of profits acquired through unauthorized usage or the payment of monetary penalties. Consequences for trademark violation could also include injunctive measures or the issuance of a cease-and-desist directive." This was signed by Barry G. Williams, Sr. Intellectual Property Attorney, with a phone number, address, and URL. A Maryland State Bar Association lookup showed no attorney by that name in the state. Googling that name showed a judge in Baltimore, MD, who probably doesn't appreciate their name being used under false pretenses. Googling the phone number did not provide any results... strange for a business phone number, don't you think? The address, according to Google Maps is a residential apartment. And the URL seems polished, and maybe they offer real services, but the fine print at the bottom says, "Trademark Netis is not a 'lawyer referral service' and does not provide legal advice or participate in any legal representation." Funny thing to say for someone who is claiming to be an attorney who wants to "help" us with our fictitious problem.
