I was contacted to sell my Mexican timeshare. I was given several legitimate looking documentation and I had checked the NY AG site to verify this was a legitimate business. It seems the business itself was spoofed and after several last minute issues, all accruing payment of which I was promised reimbursement, I finally began asking the right questions.

We own a time share in *** *** in Baja, Mexico. In Feb 2018, I answered a phone call from Mr. Shawn Campbell ([email protected], License # 10351205272) indicated that his company, Silver City Property is tasked to buy as many as 200 time shares from *** *** for a prospective buyer. He can find out how much our time share worth and ask for an offer. We have no use of time share and my child will be going to college soon so I feel I will need the money. Mr. Campbell promised that there will be no upfront fee from Seller except 6% of commission which will only be paid after the sale transaction. On Feb 13, Benjamin Camona ([email protected], Tel 518-7301325) claimed to be Escrow officer from American Finance SLP, LLC requested the information for opening an escrow account in Mexico. This was followed by a nice offer of $52,670.00 to buy our timeshare and an escrow account statement with the money funded and sales agreement. In the sales agreement, there is an item called Reimbusements of $4872.00. Shawn explained that this is TAX ID required by Mexico government but the Buyer will cover the cost. Mr. Camona then emailed updated escrow account with $4872.00 added into the account. After this, I signed the sale agreement. A preliminary closing package were then sent to me very quickly, included an instruction for international wire transfer to Mexico for $4872.00. Shawn explained that this payment must be paid directly by the seller not from escrow account but it has been funded by the buyer and I will be reimbursed after the sale transaction. On March 14th, I wire transferred $4872.00 according to instruction from Benjamin Camona from American finance. Immediately after that, another upfront fee of $6,320.4 via a wire transfer was requested to pay for ‘12% Mexico SAT tax’. This was followed by daily phone calls from Shawn Campbell and Maximillan J. Polsky (claimed to be legal counsel [email protected]) states that the this is a new Mexican law which requires the seller to pay a tax in advance of the actual sale in order to complete the transaction. The buyer has funded this tax which is held in the escrow account. They guarantee the reimbursement of this tax upon completion of the sale. I realized now that this is very much like a scam so I refused to send further money. However, Both Shawn and Maximillan have been calling daily to convince me to send the requested money in order to complete the sale. Recently they are very aggressive and threatened either we pay this money or pay commission, otherwise, serious consequence may apply.

Shawn Campbell did provide a license number, which we searched. The name and NY licensee can be found but no contact inform and no any real estate sale/ad is associated with it. We wonder if this is also an identity theft.

On Feb. 2, 2018, I was contacted by phone by Donald N. Campbell of Silver City Properties LLC about selling my timeshare in Mexico at no cost to me, just his 6% sales commission out of the proceeds of the sale. He provided a Sales Agreement. Next I was contacted by an escrow company called American Finance SLP and signed escrow papers. Then I received a statement of an escrow account from Citibanamex. Since I was not a Mexican citizen, I needed to get a temporary naturalization and federal tax ID number; this required a wire transfer in the amount of USD3,707. The next request for a wire transfer was for USD3,660 to cover the Jalisco state sales tax. I received statements for my Citibanamex escrow account noting these fees were paid. The last request for money was for a recording fee. I told them I didn't have any more cash to send. I haven't heard from them since.

received several offers to sale my timeshare in mexico.I was presented and accepted,what i through was a fair offer.After signing the contract and 2 months into this process i started to receive addendums to the contract involving large sums of money.A week before my closing date i received another request for fees that sounded suspicious.after being given the run-around i figured this was a scam

I was contacted by Peter Lane of Silver City Properties with an offer to purchase my timeshare in Playa Del Carmen, Mexico. The buyer was supposedly a wealthy Asian vacation property developer who was interested in buying timeshares in the Playa Del Carmen area before the opening of a Dreamworks park (which was recently approved). The buyer put the purchase funds up front in escrow located at Banamex in Mexico City and controlled by the title company under Benjamin Carmona of American Finance SLP, LLC ( www.americanfinanceslp.com ). Eventually the story unfold that to avoid the tax on the sale it will be necessary to file some paperwork with the Mexican Consulate which Silver City will take care of for a sizeable fee. The buyer offers to cover the fee and places the money in escrow. This is where I've cut off the dialog since it appears the next step will be that I will be asked to send the filing fees in advance to closing (under the assumption they will be returned along with the closure of the purchase). I believe this is a Mexican Time Share Wire Scam.

Sales agreement not executed until fees are paid. Once fees paid they insist on additional fees. Use intimidation tactics. Threat legal action if don’t pay.

We keep getting phone calls and emails offering to purchase our pueblo bonito timeshares. The offers seem way too good to be true and fishy. We have not proceeded as we feel like this is a scam and want to report sold elderly folks with timeshares are not targetted if this is not legitimate.

This is not a legally-binding document, It is intended to provide information as to the type of ownership being negotiated. Please provide us with proof of ownership to proceed with the sale. Proof of ownership could either be the first page of the contract or a bill you receive on maintenance fees. Along with that our Acceptance letter signed and sent back.
