U.S. law requires us to notify you if someone is trying to register a similar name and give you 2 to 3 business days to file for the trademark. Trademarks are registered on a first-come, first-served basis through the USPTO, meaning the first one to register gets ownership of the name across all 50 states.
If you find that someone else is using your business name, you can send them a cease-and-desist letter. Registering the trademark will protect your brand and prevent others from using it. If we go ahead with the other applicant’s registration and they secure the trademark, you may have to stop using your business name.
Please reply to this email within the next 2 to 3 business days. If we don’t hear from you by then, the other applicant will be able to start their registration process with the USPTO.
