I was never told that MV Realty PBCwas filing a lien against my property or about my right to cancel. However, I was told that I would never have to pay MV Realty anything unless I sold my house. I have not sold my house and do not intend to do so. The contract states I will pay a broker commission if I sale my house. MV Realty was deceptive because they knew that they were filing a lien or an instrument that was essentially a de facto lien ("memorandum of homeowner benefit") that would encumber my property for transactions such as refinancing and equity access. The contract was for sale of the property only. MV Realty breached the contract and fraudulently took an unearned broker commission of $12442.00 from my equity transaction. No contracted services have ever been rendered by MV Realty and the triggering event--- the sale of my house ---has never occurred. MV Realty must return the broker commission that they were never entitled to receive. There was no performance under the contract.
