Online Retailer Scam

$250 hoodie was bought online early December as a Christmas gift for my partner at said business's website, Item wasn’t received after a month, I contacted the business and let them know they said they would send another one, after two months without receiving the item I checked the shipping location and it had been at the same location for a month, I contacted the seller once again to let them know and at this point since Christmas was over and me and my partner were split up I had no use for it and I just wanted my money back. Seller agreed to send a refund but stopped communicating and I never received my refund either, after several attempts on trying to get in contact with the seller about my refund he had blocked me. When I check the shipping now it says “Label Created, not yet in system.” Now I don’t have my hoodie or the $250 I spent on it and since the charge was way back in December my bank won’t let me dispute the charge because they have a 90 day dispute policy.
