A contract to re-finish my basement was signed by me and Wilber Rojas Araya (the contractor) and $6900 Dollars were electronically transferred for the purchase of materials. Work was delayed by to supposed illness and other commitments. A Friday, six weeks after signing the contract and 4 weeks after having placed a dumpster by me. The contractor showed up with 8 pieces of sheetrock and two rolls of insulation. He stated that he would start the work on the following Monday or Tuesday, but he needed additional money because the materials were more expensive than anticipated. I gave him and additional $4,600 Dolars since he promised that he was starting in a couple of days, and he was going to bring additional material.

He never showed up and he stopped answering his phone. I went to his home two weeks later with a breach of contract letter. He apologized and promised that he would do good on the contract after the holidays. I told him that if he did not keep his word, I would initiate a court claim.

He never showed up, I asked him for a full refund of the money and cancelled the contract. Since no answer was ever received, I filed a civil complaint, and I am working with the police in my town to file a criminal complaint as well.
