Whittaker Ford sent us a lottery game by postal mail, indicating we had the chance to win prizes up to $25,000 if we visited their car dealership.

When we arrived, they refused to give us our prize, and coerced us to consider the cars they had for sale. They gave false information about the sales terms and pricing they were ultimately willing to offer, they asked for personal identifiable information in order to claim our lottery prize, and then used that information to run a credit check without our consent. They also pressured us to make a $200 payment to hold a particular vehicle of interest.

We then felt they had either made an error in their sales prices, because they seemed to be asking for double what we believed the vehicle to be worth, or we began to sense that they might be scamming us for a large amount of money. We were finally given our prizes, which were cheap $1 earbuds, and asked to return the next day to finalize the sales terms.

When we returned the next day, after carefully researching the vehicle's value, we asked the sales team to explain why they were asking $41,000 for a 2021 Chevy Trailblazer LS with 19,000 miles, when our research of local listings, Kelley's Blue Book, and Edmunds all showed the fair market value for that vehicle was $21,000.

They tried to explain that it was legal in the State of New York for car dealers to cover their losses on cars in their possession that had negative equity due to the car dealers paying off the balances of the previous owners liens. They tried to explain that car dealers would sometimes assume those debts, of negative equity, for strategic purposes such as regional sales quotas and bonuses.

They did not seem to be prepared for our research and questions. We pressed them to confirm that they were in effect trying to pass that debt, which they had assumed from the previous owner, in a concealed manner to us as the new buyers. And to confirm they were not willing to offer a fair price in the range of $21,000. They responded that, yes it was legal for them to cover their losses in this way, but that they would drop the price to $37,000 for us.

We feel that less informed buyers are in danger from this car dealership. They manipulated us into providing our personal identifiable information, ran a credit check without our consent, and then pressured us to assume $20,000 of their debt through the $41,000 purchase of a car valued at $21,000.

We have not found any validation of their claim that it is legal for car dealerships to conceal their debt in this way, or to pass that debt to their customers. We feel that Whittaker Ford is operating a scam, defrauding its customers of large amounts of money, and potentially violating state and federal laws by not informing buyers of negative equity or previous liens.
