We purchased a Devon Rex kitten that showed as available through the Faerietail Devon Rex Cattery website (see https://all4salemanxtech.com/). The $850 cost of the kitten and delivery fees were paid using CashApp on Sunday, September 13, 2020 (see Account $DaveSabrinaAnderson). The discussions we had with the cattery were with Charles Haynie, allegedly the breeder, and a Paul. The original commitment was to ship the kitten in a safe manner for delivery on Tuesday, September 15, 2020, using Globex Shipping (see https://theglobexshipping.com/). There have been numerous communications and delays that have resulted in the kitten we selected not being delivered. The kitten did not arrive on Tuesday. An updated communication indicated that the Kitten would be shipped on Wednesday, September 16, 2020, with an arrival time of approximately 10:30AM. At approximately 9:30AM on Wednesday, we received notification that the carrier used was not suitable, but one could be rented. A deposit of $1,200 would be needed to rent a climate-control carrier, but 95% would be refunded on receipt of the Kitten and return of the carrier (see CashApp $GlobexShippingLane1). We were then told that an insurance policy needed to be obtained to protect our investment. There were several levels available, including one for $2,500 that would allegedly result in a full refund if there were no claims on the policy. Once those issues were satisfied, we were told the Kitten would arrive in the San Jose area at approximately 5:30PM on Wednesday, September 16, 2020. At approximately 5:00PM the shipping company informed us that the Kitten was delayed in Chicago, Illinois. The website for Globex Shipping stated, “Your order can not be shipped due to extremely poor weather. Check your email for more details on this and steps that need to be taken.” The website for Globex Shipping indicates that they are “Golden Circle Movers ?? a full ??rv??? logistics & cargo company, ?ur ??m ?? t? g?v? the b??t to ?ur various clients ?t ?ff?r?bl? ?r???.” They secure, fast and risk-free transportation and pet relocation. On Wednesday evening, we were told the kitten would be delivered on Thursday morning. Throughout this process the breeder was reassuring and apologetic that the shipping fees were not clearly communicated. He reassured us that the goal was for the kitten to be delivered safely.

At approximately 10:00AM on Thursday, September 17, 2020, I called Rick Lee, our contact at Globex Shipping. The v-mail greeting on 469-249-2990 indicates you have reached Golden Circle Movers and appears to a Texas phone number. I left a message requesting a call back. On Thursday, September 17, 2020, at approximately 11:30AM, Globex Shipping called asking for another $2,500 to create a document to prove that we are allowed to adopt an animal out of state. At 11:57AM, Rick Lee called back, and we refused to pay the requested amount. We stated, “The Department of Agricultural and the state of California only requires a health certificate or certificate of veterinary inspection (CVI) for a breeder to ship across state lines. A cat is not a restricted species, so no other documentation is required.” This observation was not well received. Rick Lee implied I had no right to question him and hung up on me. Around the same time, the breeder accused me of being insulting and blocked my calls and text messages. The Faerietail Devon Rex Cattery is also not responding to e-mail messages.

On Thursday, September 17, 2020, at approximately 2:30PM, Globex Shipping sent an e-mail indicating that the kitten is being detained in Chicago, Illinois, unless the fee for the city permit $1800 is paid. (Please note that the amount changed from $2,500 to $1,800.) The rationale that they provided was: "due to pet overpopulation and kitten mills in the state of MA, no one is authorized to adopt or purchase pets out of the state of MA without a city permit which your kitten does not currently have and is being detained." We pointed out that the kitten is not beg detained in Massachusetts and we do not live in Massachusetts. This resulted in Rick Lee being hostile and hanging up the phone. The breeder is not actively engaging with the shipping company to resolve the issues. They made all shipping arrangements, not us.

Nobody is telling us if the kitten is being cared for or safeguarded. At this point, I do not believe the kitten actually exists. I also believe that Charles Haynie and Rick Lee may be the same person. Although we have not spoken to Charles Haynie, there are similarities in the language used in text and e-mail messaging.
