I have an infant son who struggles with acid reflux. I found the website https://www.infant-acid-reflux-solutions.com/ which contains information about reflux and they offer appointments with a doctor for prescription medication. I purchased and set up an appointment with Dr. Jennifer Prince and during our 20 minute appointment, about half of it was spent listening to her sales pitch about a product called TC Max. It's a compounding solution that makes over the counter reflux pills into a liquid so babies can take it. It is only offered for sale through them.

I was disappointed in our call and that I paid money to basically listen to their sales pitch, so I requested a refund, in which the owner of the company promptly refused a refund and told me never to call her again. My husband attempted to call her back and she told us to go through PayPal to request a refund and hung up on us.

I started to dig into the company a little more and was very disturbed at what I found. I found a warning letter from the FDA dated February 2018 stating that the company had an unapproved new drug violation and a misbranded drug violation and they had 15 days to fix the issues:

The website http://www.infant-acid-reflux-solutions.com/ no longer has any information about Tummy Control Max. But the website https://tcmaxcompany.com/ does. They offer the product now as "TC Max". In the FDA's 2018 warning letter, it stated the following terminology was a violation: "When a PPI is compounded with our product it will become an immediate release PPI rather than a delayed release.". The verbiage on their new website is "TC Max creates an immediate release formulation so you can dose right before, during, or after a meal!". They are also still claiming that it can create a long term stable product. Nowhere on the website does it mention that the product is FDA approved. They will also send you this verbiage through their patient portal (ClockTree) after an appointment, trying to sell you the product.

I also found an article by the Chicago Tribune that says the website www.marci-kids.com was removed from the internet about 10 years ago due to similar FDA violations:

I cannot find any information anywhere online on what TC Max actually is. There are no ingredient lists anywhere on their website. A mom in a Facebook group sent me an image of a packet (see attached). The product was sent to her like this, in an envelope, with no outer drug carton to reference for a list of non-active ingredients and NO instructions on how to use it. She even bought their "starter kit" which also did not come with instructions, they were sent to her online through Facebook after purchasing.

A couple of other very suspicious things I noticed, that may or may not have to do with the FDA:

1. Their doctor, Dr. Jennifer Prince, lists her D.O. license number as 14479. I am having a hard time verifying this. I checked Florida, California, and Kansas doctor of osteopathy websites and I'm not finding anything. Dr. Prince lives in California so I assumed it would verify there. Maybe I'm looking in the wrong places but it's been very hard to find.

2. We signed an agreement before the appointment that says if we aren't happy with the value of their services, we can request a refund in full. They denied us a refund and proceeded to change the terminology on their website. They added "If you have executed your appointment there is a no refund policy. Regardless of any Patient & Provider Service policy agreement". This did not exist on their appointment instructions before our appointment. We have screenshots to prove they went back and added this after we requested a refund.

3. There is a clause in the practice and provider service policy that patients have to sign before an appointment that basically states that services will be terminated if a patient makes any sort of statement or claim based on opinion on the company either verbally, on the internet or on social media. It's basically saying patients cannot say anything bad about the company or else they'll be dropped as a patient with no refund.
