Hello, I hired a website designer, Spark Lab Studios, to create a site for my company *** ***. I paid Spark Labs Studios $170 to start the work with the understanding that I would pay another $170 at completion of project. A website was created; however, I am dissatisfied with the product. Spark Lab Studios has requested that I pay an additional $500 for 'overcharges' on an unfinished website. I have asked Spark Labs to deliver the website files with the understanding that I will pay the final $170 and pay another designer to finish my site. This is unacceptable to Spark Labs and they claim to be filing a lawsuit for the now $670 bill for a website that I do not want.

I have attached a copy of the email exchange (below) between me, *** ***, and Ian Goodwin of Spark Lab Studios. To view the website, for which I provided all photos and most of copy content, go to ***

I see you have no interest in being reasonable here. I was open to allowing an agreement to be arrange on the over work cost and delays. However this doesn't seem to be the route you wish to travel.

You signed a contract. You owe $500 in over work cost, and the final installment of $174.50 upon work completion.

To date you've received 30 days of professional work and only made a down payment of $174.50 on 12/29/15.

It's clear now you hold Web Designers and Developers in very low regard if you believe paying them $0.75 cents an hour is a unquestionably justified rate of employment. Entry level McDonalds employee's make $15 an hour, $120 a day at minimum wage. This comes to 2.9 Days of work at the $349 price you were given to represent your business online with a new professional website and company logo. I threw in a free logo design out of good will, which you've had me redo 6-7 times, far past the 'Two Revisions' of the actual $59 PAID logo design service provides in the first place. Taking advantage of people is never a good practice. To date you have been designed a $2,000 website, better than the top ten 'Seattle Chocolate Company' competitor sites displaying on google's first search results. Yes, each were fully reviewed. If you believe your website is some 5min Wordpress install easily duplicated, you're greatly misinformed. Every item has been made from scratch. Even the menu bars (most commonly unoriginal copied area of a website) There is no other website in the world like it. Original website designs and layout copyright ownership cost on average $1,500 and quickly goes up from there.

It's clear none of this means anything to you. You simply don't care. I'll word it out regardless for the record. Since we Web Designers and Developers have to fight tooth and nail to eat the scraps fallen from peoples tables. Unfortunately $0.75 cents per hour makes it hard to eat at the end of the day in the USA.

Your original color pallet of Purple, Gold and Black was changed last minute after 30 days of work to a NEW color pallet with apparently zero concern or thought for myself (the designer). Yet, you miraculously feel you're the one being ripped off when asked to cover these multiple extended works and time periods. Absurd.

Read your contract. You signed and agreed to over budget cost due to changes and delays in providing needed materials. These articles should have been provided day 1. Not 30 days after work already commenced.

Just because you went to Belize for a week doesn't mean work stopped. This assumption of yours is completely groundless. You made it up.

No idea where this $150.00 sum of money you keep mentioning comes from. Apparently you make up your own new payment agreements as well. Even less money than originally agreed.

You're confused, I never made that statement. You emailed asking about your website. I responded it would be online for review in a few days. This was due to your website files still at that moment being on the local server where majority of work is done. You emailed late Friday night I believe, I said we can review on Monday. You said great thank you.

How you twist this around to make a false claim that "I stopped work", or, "Did not work all 30 days" is again groundless and unfortunate on your part.

I expect the signed agreement paperwork to be upheld. Work has already been completed past the original agreement.

If you refuse to pay your bill, I will sue you at Pierce Country District Court. In addition, if you commit fraud and theft by doing a Credit Card Charge Back of your $174.50 down payment (12/29/15), I will sue for the sum including all allowable damages under law.

As the previous email mentioned, rework and long past extended work period going over a month now. Last minute changes to website when work is already completed raises cost, time and resources. The low price of $349 is marketed within a time period and strict deadlines in order to meet reasonable profit margins. When these restrictions are over extended payment needs to be met. I'm sure you can understand spreading work out over 30 days as asked is not reasonable for any type of business model.

As stands, your current website is easily valued over $1,000 in the market place.

Original work period was two weeks. Sorry, but cannot work on your business for 2-3 months for $349. Your price never included that timeline.
