A California company named Smart72 lied to me on March 28, 2023 to convince me that I needed to replace the ductwork in my home at the cost of $12,100. I am a 65-year old widow living alone in Salinas CA.

This company installed a new furnace for me in 2020 and I upgraded to add an air conditioning system in 2021. As a result they convinced me to join their “club” to have them visit my home for a few years for them to do a maintenance inspection twice a year to make sure the system is operating correctly and for them to replace the filters.

Two representatives of the company came out to my house on March 28 for this preventative maintenance inspection. One employee was a young man and the other man is his supervisor. They inspected my system and took photos of my ductwork under the house. The young man showed me the photos and told me the photos evidenced that my ductwork needed to be replaced. One of the photos showed a cut in the black plastic sheathing around the ductwork with the insulation exposed. Another photo allegedly showed where the black plastic sheathing had “pulled away” exposing the insulation under the sheathing. The employee told me this evidenced that my ductwork was compromised and because of this my HVAC system was both heating and cooling the area under my house when the HVAC system was running. I was unfamiliar with what such ductwork should look like and how it worked. So I asked the employee, “Are you saying that there is nothing beyond the insulation that keeps in the heat and cold air and that the insulation is all that holds the heat and cooling inside the ductwork, and am I understanding correctly that the air is thus coming through the insulation since the black plastic sheathing is cut and pulling back?” To which the young man told me that was correct and that all of the ductwork should be replaced in order for me to not be heating/cooling the crawl space under the house.

Either he or the supervisor also told me my ductwork was designed primarily for heating and not for cooling and new ductwork would fix that problem. He said mine was not properly sized since I added the AC unit. (NO ONE from the company told me this in 2021 when I spoke to the company about installing the AC unit). I was told replacing the ductwork and adding an air scrubber to the system (recommended by them) would cost $14,000+. I told the employees I wanted to get additional quotes. When I said that, I was told that because I am a club member they would call the headquarters and see if they could get me a better price. They made the call and then told me the price for this work would be $12,100. They also told me I could use my Home Depot card which would give me 2 years to pay the cost at 0% interest—they are a Home Depot approved contractor.

I agreed to charge my Home Depot card for this work. A few days later however, I cancelled the agreement because I remembered I had a home warranty plan that might cover this.

My home warranty plan sent out an independent contractor (the business owner of an HVAC company) on April 6 to assess the situation of my ductwork. After inspecting the ductwork, the contractor told me 1) there was nothing wrong with my ductwork, 2) it was properly sized, 3)there were no leaks that he saw, 4) he showed me the actual ducting tube beyond the insulation, 5)he showed me he found no leaks in the tubing, 6)he placed tape over the cut in the sheathing, and 7) and said that if he were asked to replace the ductwork, he would not do it because that would be dishonest.
