EXPERIENCE:
? This has been one of the worst retail experiences that I have ever experienced. It appears that my money may have been stolen under false pretense. I can only assume at this point that the seller never intended to ship a NEW elliptical but the intent was to dump a USED one on an unsuspecting consumer. The seller’s representative has lied continuously throughout the process and has only strung me along with a false sense of concern on their part alluding to an appropriate resolution to this mess they created and that they seemingly do not plan to correct. At one point, the seller’s representative tried to manipulate me into placing another order for an elliptical as a way of getting the NEW one that I wanted while they corrected the problem with the first order. The seller wants to extort more money out of me by having me pay to have this box shipped back to them in order to get my refund. They are holding my refund hostage. I refuse to pay the shipping costs for an error that they created.
Further inspection of one of the labels on the box that was shipped to me from MASOU reveals that it was sent from one Yosuda/MASOU location in California, USA to a different Yosuda/MASOU location in California, USA before being shipped to me. This is not the usual retail process and supports the possibility that this purchase was a scam.
? Ordered May 17, 2023:
o YOSUDA Pro Cardio Climber Stepping Elliptical Machine, 3 in 1 Elliptical, Total Body Fitness Cross
Trainer with Hyper-Quiet Magnetic Drive System, 16 Resistance Levels, LCD Monitor & iPad Mount
o I placed an order for a YOSUDA Elliptical Machine on May 17, 2023, through Amazon Marketplace. The order shipped on May 18, 2023 and my credit card was immediately charged for the purchase. The package was delivered on May 24, 2023. I contacted Amazon on May 24, 2023 immediately upon receipt of the package to inform them that the seller sent an obviously USED elliptical. I paid for and expected to receive a BRAND NEW elliptical as advertised. The box remains as shipped by the seller and has not been opened.
It is obvious looking at the condition of the package that the product is USED. The box is old, worn, dry-rotted, filthy dirty and has been taped and retaped to seal it. The packaging is so old and busted, the box has been reinforced with yellow ties to help support the contents. Additionally, the parts that have been included in the box bang against one another when it is moved and is not the usual situation for a NEW product that has interior packaging materials to protect them. Amazon stated that they would contact the seller and have them respond to me directly.
I have been in contact with this seller since May 25, 2023 regarding this problem and they have yet to satisfactorily correct the issue. I have complied with various different requests by both Amazon and the seller, including submitting pictures of the package, and have spoken with a number of people regarding this matter and my concern has been forwarded to various different levels so I was told. In the meantime, while I wait for a decision to be made, I am out my money, may incur bank interest charges for this outstanding amount and I have a huge gross looking box blocking entry and exit to my apartment because the seller refuses to retrieve their package.
To add insult to injury, I have since discovered that the seller’s representative misrepresented what actions he/she was taking to resolve this matter, appears to be purposely delaying the appropriate resolution of this complaint it seems to allow the refund period to expire, and has also misrepresented his/her company’s refund/return policy. He/she has also deflected blame to UPS and Amazon as well. While, I am not pleased with Amazon’s handling of this complaint, the problem originated with the seller. I have included the transcript of my communication with this seller in my initial email to Ms. Angie Barnett, President and CEO, Better Business Bureau (BBB). It includes an excerpt from Yosuda/MASOU’s refund/return policy for your reference at the end of the communication. I also provided pictures of the package that were provided to Amazon and the seller as well.
This is a problem caused by the seller. Unfortunately, it is necessary for me to seek outside help. I am writing to request your assistance in getting MASOU to refund the full amount of $370.99 I paid back to my payment method at the time of purchase, pay any interest charges incurred as a result of their delay and I am requesting that they have a delivery service like UPS PICK-UP the package that was delivered to me postage-paid by the seller.

? Seller’s representative pretended to be someone that could be trusted to resolve my issue all the while doing nothing to correct it
? Seller’s representative willfully used misrepresentations about steps that would be taken to resolve my issue; what he would do to correct the problem; what others were going to do to; what the refund/return policy is; false promises
? Seller’s representative tried to encourage me through manipulation to buy another elliptical on May 29, 2023 by stating:

return label on Amazon. And here is its tracking number: UPS 1Z82Y9660337226672. Please
download it and package this item and send it to the ups store with the return label. As for the
exchange, due to the return request you submitted on Amazon, I am concerned that the exchange
order re-sent by the seller did not make it into the system. Can you place a new order to get new
items? Please let me know if there is any problem. Sincerely, Wanna
? Seller’s representative is using extortion as a way to force me to pay to have the box that they shipped to me returned back to them before they will issue me a refund
? Seller’s representative used secrecy refusing to escalate the concern to anyone else when asked
? Seller’s representative used charm, disingenuous concern about my issue and the inconvenience I experienced
? Seller’s representative deflected the problem onto other entities: onto UPS stating that the box is the condition it is in because it was damaged during shipping; onto Amazon stating that MASOU must follow Amazon’s return policy rather than their own
? Product was offered at a huge discount (@ 9% reduction and an additional $150.00 off regular price)
? Deceptive advertisements
o Seller advertised a NEW elliptical machine but provided a USED one instead
o Seller placed a sticker on the box advertising the product as new; however, it is used
o Seller’s website advertised the following:
“Hassle Free Return”
“30 Days Money Back Guarantee”
o “Return or exchange an item within thirty (30) days of delivery, provided the merchandise is unopened, unused, in its original packaging and condition”
o “Yosuda Bikes will pay for the cost of return shipping if the reason for return was result of OUR error”
o “Examples of instances may include: Item arrived defective and cannot be fixed with a replacement part We shipped out the wrong item # We shipped it to the wrong address We shipped a duplicate order Item malfunctioned during the 30 day returns period (Assuming the customer assembled the item properly per the instruction manual)”
? Insistence that I remain patient while staff investigate the process. However, fifteen days later and there has been no appropriate resolution. The refund period for this purchase expires June 25, 2023.
