The three business entities schemed together in the following way. The scheme began on April 8, 2021 when I purchased a puppy listed on the Puppy Garden website. I paid $789.00 to Puppy Garden using Venmo per their requirement. I have multiple text conversations with “Ann Marie,” their web sales agent, detailing instructions how to pay (see attachment #6). The Venmo payment was received by “Robert PG Smith” on April 9, 2021 (see attachment #1).
On Saturday morning, April 10th, I received an email from Guarded Hands (GH) that our puppy would be delivered to our home in Omaha from a departure point in Virginia. Early that afternoon, GH sent another email that a special transportation crate was needed. The email included photos of the special thermal crate and that it was required to insure safe travel. They also guaranteed that the $990.00 crate was fully refundable and should be paid only using an American Express gift card. Including tax, I paid $1001.95 on 4/10/2021 to Guarded Hands Continental Logistics (see attachments #2 & 3). I spoke several times with “Thomas” of GH who was in Arizona. Later that afternoon, Thomas sent another email saying that an additional $2500.00 was needed for “partial Refundable Insurance.” At this point I suspected a scam and fraud was at hand.
I immediately contacted American Express to cancel the two gift cards, but GH had already cashed out the cards to make an unauthorized purchase at Elite Restaurant Equipment (ERE) in Newark, NJ. The ERE Merchant ID is 161 283 1289. The American
Express Transaction IDs are: 03001B229B37 and 06001B1S6931. On the guaranteed refunds, I also phoned Thomas at Guarded Hands demanding a full refund on 4/10, 12, and 13, but he did not answer my calls. Finally, I phoned ERE on 4/12, 13, and 16 and spoke with Jessica. She said a 30-day investigation was necessary, but after 30-days they refused to refund the unauthorized purchase of $990.00 and stopped answering my follow-up calls as well.
All three companies are operating a sophisticated but evil scam business and need to be prosecuted. I am respectfully requesting full compensatory, punitive, and consequential damages as stipulated by law. From Puppy Garden, $7890.00, and from Guarded Hands, $1001.95 ($495.95 and $505.95, respectfully).
I’ve also included text correspondence with Puppy Garden and Guarded Hands implicating their deceit and falsehoods.
