Proceedings Department Reports & Reviews (1)

- Chicago, IL, USA

Someone claiming to be an agent of Proceedings Department called my aunt’s home phone number leaving a message that I should contact 8554098952 and left a case number and said they were from the Cook County Court.

So, I called the said number and a man answered me. I provided my last name and he then asked me if my first name that he said was correct. I said yes. Then he told me that I have a case filed against me and that I was due to appear in court. When I asked what was my case about because I never received any formal letter coming from an attorney or a judge or any law firm. The man said he was not at liberty to say unless I give them permission to open up my file. I said I give them permission. He then placed me on hold for a couple of minutes and then he got back to me. He said that I have two cases from Surge credit card who was suing me for 1) breach of contract or agreement and 2) fraud. He told me that I have an unpaid debt of more than $1,500 that must be paid immediately if I agree to resolve the matter and to stop the pending court hearing. I said I cannot pay in full because there is no possibility of me paying all at once given the circumstances that I quit my part time job and that my other job pays me less than $500 net every two weeks. I said that it really was not possible. He asked me if I wanted to settle this case. When I said yes. Then he put me on hold again saying he was going to ask his supervisor if they could accept a settlement. When he came back, he told me that I must pay them $900 that day to avoid trouble. When I said I cannot but I could only pay in instalments, he asked me how much can I pay each month. I said I could afford $25-$50 per month only. The man then sarcastically said “Do you realise that it is going to take you three years if you pay $50 a month?” I said that was all I can afford. He said they cannot accept my offer and then he threatened me that if I did not pay them that day, I would be charged with obtaining credit by fraud and said “Good luck in court!” I said I wanted to be given or sent a letter for me to review my case, but he again threatened me and repeated “Good luck in court!” When I asked him if he was threatening me, he hung up the phone. Then I was convinced with my suspicion that maybe he was a scammer.

I tried to google their phone number and the name Proceedings Department but I could not find anything online.

Could you please advise me on this and tell me if what I received was a legitimate call from a debt collector or a fraudulent scammer because I don’t think any debt collector would threaten you like that.

Thank you.
