unfortunately on 2/12, on Chestnut St. in San Francisco, my willingness to help people got the best of me & I fell for a scam that was exploited by a loophole in Bank of America's check cashing service for long time customers. It started when an African American man in his late 20's approached me & asked if I bank with Bank of America & if so, if I could cash a check for $4762 for his sister who he said was going to college to SF St. & that she need to cash this check right away so she could pay her rent but they would give me $40 for my trouble; I figured they were asking me to cash it because they didn't want to lose the money that a check cashing place would take out. I replied that I would try to help because I've been a desperate college student so I understand the situation, but I don't think they'll allow me to do this & with put a hold on the check. The guy's sister then came showed up, but my name on a check that had the amount on the check already written out & signed for a company Porter Consulting LLC. I then went into the BofA, & asked the teller if it was ok to cash this check even with less than $50 in my account. To my surprise, the teller did without asking me anything else & without any suspicion, so I went out to give this girl the cash, she said thank you & gave me the $40 & we parted ways. On 2/19 I received notice that my account was below $25, & when I went to check my balance it was -$4063 (this wound up claiming my paycheck & tax refunds). When I was waiting at this particular branch, a woman overheard my story & told me this same thing happened to her a year ago & was terribly sorry I was a victim, so part of my shock in all this is that BofA seems to know this is an ongoing scam but doesn't warn their customers at the time that they may be unwittingly participating in a scam, because I would have not done this if the teller had told me this could be fraudulent. After getting so little help from BofA at 1st, it was only after I went to the police that they were shocked the teller did this & told me I need to get a copy of the check 1st, which I wasn't able to get until my next visit. I was told by BofA that they cashed the check, despite the fact that my balance was below $50, because I've been a longtime customer (19+ years) so that was essentially their was loophole that got exploited; so unfortunately, unless then fraud claim is successful & or these people are caught, I'm on the hook for this amount with no feasible payment plan for someone with my low finances. I'm a person who makes minimum wage, lives paycheck to paycheck & has been paying off my student loan debt, my financial situation is now a complete nightmare with no resources to help me out.
