Paychex actively solicited the Submarine School for participation in the ERTC program, beginning in early 2022.

Paychex repeatedly assured us that we were eligible for the program, and based on those assurances, we approved the filing of the ERTC paperwork in March of 2022.

In July of 2022, Paychex assured us that the ERTC paperwork was “100% filed,” and that our refund (which Paychex assured us would be $17,800 would be received within 4-6 months after the March filing.

Relying on these repeated assurances from Paychex, we moved forward with renovation work on our small business. We incurred substantial debt, based on our reasonable expectation – which Paychex continued to reinforce until as recently as two weeks ago – that ERTC paperwork had been filed, and that the full tax refund was forthcoming. Those improvements and the related debt have caused our business to incur substantial interest.

Within the past two weeks, we have received communication from Paychex suggesting that the ERTC paperwork was never filed, and that we were classified as a “lost client.”

The initial email from them indicated that Paychex was working to rectify this error, but the last email we received from you suggests that Paychex is unable to do so, and that Submarine School may not have been eligible for ERTC from the outset.

Paychex suggested that the charges for submitting the ERTC paperwork were refunded in April of 2022, a fact we cannot confirm because of the misleading way that Paychex tracks services and payments (more on this below). Regardless, throughout summer of 2022, Paychex was continuing to assure us that (1) the ERTC paperwork was “100% filed”; and (2) the tax refund that Paychex promised would arrive in a matter of months.

We have made many efforts to work with Paychex to resolve past issues, and have been patient with the apparently false assurances from Paychex about the ERTC refund. At this point, however, Paychex has cost our small business thousands of dollars, and appears to have no interest in rectifying this issue.

As of last week, our hope was simply that Paychex would file the ERTC paperwork, secure the refund that Paychex promised, and agree to compensate us for a reasonable amount of the losses described above. Based on their most recent email, however, it was revealed that Paychex baldly lied to us about our eligibility for ERTC, about the status of our application (which was never “100% filed”), and about the refund we might expect.

I am so sorry for your bad experience. You should have been kept in the loop the entirety of the experience. What is even worse, is that (IMO) 90% of what is out there at this point is a scam regarding the ERTC...
Do know thought that the ERTC program is a very real program and it takes an expert to do this, to keep you posted, to qualify you accurately, and to also tell you things like:
You should not plan on spending and funds until you have: 1) Received them; 2) Paid the commission to the company which did the work and filing for you; and most importantly: 3) Amended your 2020 and 2021 tax returns and paid the appropriate taxes owed on the employee tax credit.
What is leftover after this is what you are free to spend. It is a 9 month process and you should not do anything, or plan anything until after all is said and done. I know, too late...
The fact is that companies make all these great promised but do not inform you that you should only plan on keeping 50% or so of what you legally and accurately qualify for.
Additionally, you also (should everything have worked out well - which it did not) have had audit protection incase the IRS came calling and you had to prove you qualified correctly.
Most companies offering and pushing this ERTC promises do not offer REAL audit protection and Attorney Opinion Letters, which the firm I represent does!

It is so important to beware of CPA's and accountants doing this service for you. Why? The law firm I represent has received over 100 of these filings before they were sent to the IRS. CPA's and Accountants wanted a second opinion of their work and here is what we found: 100% of all ERTC filings sent to us for review by competent CPA's and Accountants were wrong. They were incorrect. Every.Single.One. They all overqualified their clients. You DO need an expert and an attorney to help understand the 800+ pages of legalize. So be careful who you choose, because it will be you who pays the penalty!
