I engaged the copywriting services of the individual to write copy for a website + email marketing & social media in June 2022 with an estimated completion of September 2022. I paid 3 monthly instalments from June-August 2022 ($1000 USD each). As a note, I also worked with this service provider, delivering services to them (from July 2021-November 2022), and so I decided to use them for services when I required copywriting work. The service provider had a death in the family in October 2022 and while I tried to work through this with them by pushing the deadline back a few months, with a lack of any deliverables given to me by November 2022, I requested a refund to terminate the project as they clearly had not started the project at all and I need to engage another service provider for the project.

After I officially requested a refund on November 15, 2022, as well as cancelling my services to them so that the amount they paid me each month (half of what was owed to me), could be returned to me in December 2022 and January 2023. The contract for their services stated that if the service provider was not able to render services, they would be given a 14-day grace period (which I more than gave), after which the payment would be refunded back to the client. I received no response from the service provider until November 29, when they offered me other services in lieu of a refund. I replied back on the same day about still wanting the refund, especially given the fact that they no longer had the monthly financial outgoings of my services, however no reply or acknowledgement was received.

I followed up with the service provider in February 2023, where the service provider acknowledged them owing me a refund and immediately transferred me $1,000 (1/3). They stated that the remaining $2,000 (2/3) would be returned to me by the end of March 2023.

After numerous follow-ups in April and June, they are now no longer responding to me and still owe me the $2,000 for the services they did not deliver on. I have uploaded the emails sent from February 2023 onwards, with my personal/business details blocked out. I can also send copies of our messages in Slack about the project if needed (where I formally request the refund).
