I have signed a contract for installation of a new concrete swimming pool with National Pool Construction, Inc. Through a turbulent experience with this company, I have learned that National Pool Construction, Inc. is not registered, licensed nor insured, and has dissolved or ceased operations more than a decade ago. The current company's name is ******** **** *** **** **** but this is not who I had a contract with. Upon this discovery and assumption that both companies have common ownership, I've had my attorney prepared an "Assignment and Assumption Agreement" so that the company that has a current license and insurance take over the contract and assumes the liability. Unfortunately, the owner of the company has chosen to walk away from his obligations and never finished the project. As a result, I was forced to finish the project using other subcontractors at significant loss of money and warranty.
