On 12/12/17 we came across an ad on Craigslist for season snow removal. Syracuse was expecting a snowstorm the next day and we wanted to be prepared. We called the number for M & M Construction and spoke with "Mark" Ryan. He quoted a price of $1200 for two properties but with applicable discounts (late in the season, multiple property, etc) the amount came to $700 We told him that we needed to discuss the amount and would ring him back. Within 15 minutes, "Mark" telephoned us back, saying that he only had "two slots left and someone else just called". He was offering us first refusal.

We ultimately agreed. "Mark" said that he would be over in 45 minutes with a contract for us to sign. He was at our house within 20 minutes. The contract stated that we were paying for service on two properties: one property would have the sidewalk and stairs shoveled, the other property would have the driveway and walkway shoveled with snow brushed off the car. Both properties would have rock-salt applied and there was a snow-removal-from-roof option available for free, if we wanted it. I wanted to pay by check. "Mark" wanted cash, but agreed to the check. He left the room and (allegedly) rang his father, who had me write the check out to the owner of M & M Construction, his grandfather,"Mike Ryan".

We had snowfall overnight and into the next morning (12/13/17). Around noon, I telephoned "Mark" because his crew hadn't arrived. He assured me that they were "on the way". Ultimately, the crew arrived well after dark...some five hours after my telephone call. They did a fair job, but didn't use any rock-salt. There would be no more snowfall for 8+ days.

On 12/15/17 (two days after the snowfall) I went to the other property and noticed that the sidewalk and stairs had not been shoveled. I took several pictures and then telephoned "Mark". He wasn't in, but a man named "Nick" said that he was a brother and offered to take a message. When I stated that the second property hadn't been shoveled, "Nick" seemed surprised and said that it would be taken care of. I told him that I needed to speak with "Mark" when he returned to the office. Two hours later, I telephoned "Mark" again, but he was still out.

Online banking showed that the $350 check had been cashed on 12/13/17. Mike Ryan used his drivers' license and Syracuse University Identification to cash the check.

Yesterday (12/22/17) we had another snowfall. I sent "Mark" a text at 10:30 am, just to make sure that our two properties were on his crew's list. He replied by text, saying that we were. Two hours later, I sent another inquiring text. "Mark" responded that his crew was just entering my neighborhood. Two hours later, I sent another inquiring text. "Mark" responded with several 'thumbs up' emojis. After another two hours passed, I telephoned "Mark". The phone rang several times before going to his voicemail. Twenty minutes later, I called again...my call went directly to voicemail.

I sent "Mark" several texts, which went unanswered. On a lark, I telephoned him from a different telephone and he answered immediately! When I asked him where his crew was, he exploded. He went on a rant about how his crew got into an automobile accident and how he was in the hospital with them. When I mentioned that if I had known the circumstances--- he cut me off, shouting that his father was in a coma and his brother had two broken legs. I thought we were talking about his crew...so his crew is his father and brother? Okay. I didn't know that.

"Mark" continued to shout in my ear and talk over me. He said that I'd been pestering him all day, leaving voicemail and texts... I reminded him that we've only had a contract for two snowfalls and he hadn't addressed a single property completely. That's when he shouted that he went to the other property on 12/13/17 and there was "two-tenths of an inch of snow! I took pictures!" I let him know that I took pictures, too, and suggested that we compare them. He never mentioned the other property again.

He continued to berate me over the telephone. He implied that I was insensitive and callous because I expected him to honor our contract. I reminded him that I didn't know about his father and brother, but "Mark" continued his tirade. Ultimately I told him that the business relationship wasn't working out and that I wanted a refund (minus the work that had been done). He said that he didn't want to end the contract and that he couldn't issue a refund until he spoke with his "higher ups"...his father and brother who had been in the car accident.

He said that he would "look into" my refund, but would "personally come over and shovel" my two properties immediately. Two hours later, I received a text saying that he needed to pick his daughter up but that he would be over right after. Two hours after that, he sent a text saying that he had "just dropped off" his daughter and was going to get his supplies and would be at my house in a few minutes. Obviously, he never showed up.

While I waited for his non-arrival, I did some internet research. His profile on Facebook is "Mike Ryan" not "Mark" like he told me. The M & M Construction Company is really called M & M & Sons Construction....and their telephone number has been disconnected.

I sent him a text a few hours ago, (again) asking for a partial refund. He responded that his father and brother were being discharged from the hospital today and that he needed to get a cancellation contract together. He said that he would be at my house on Monday. Uh, Monday is Christmas Day....but it's not like he's ever going to show up, is he?

When I mentioned that I was posting my experience with him online, he had the GALL to tell me not to. He went on to assure me that he's going to show up on Monday....presumably like he was going to show up last night.

So now, we're out $350. Please stay aware, folks! Do your research! I'm in the process of gathering enough information to take Mike Ryan to small claims court, but as you know, even if you win a favorable decision in small claims court, the courts have no way to enforce repayment. A hollow victory at best. But I have a paper-trail of sorts. Pictures, texts, a worthless contract, a cashed check.
