On July 12 I made a contract with Carlos Fontes. To do back yard (grass,pergola, grill , front and back weeds) He was charging $5500 for everything with 60% down ($3300) The invoice or contract stated 10-14 days to finish. We gave him the $3300 he started the job but he started missing days one time is was family death , weather , one of his employee got caught immigration , material wasn’t here yet, just accident , then broken rib, Internal bleeding, spleen , blood clots so many mri etc etc . I understand. Things happen but we were kept in the dark he would just text the reason he wasn’t gonna show up to finish and then we wouldn’t hear back till the next excuse. I let him know the he had till today to. Be here or I wanted my money back and this morning he AGAIN. Was in the hospital with fever and shortness of breath at 6:20 am he send us a message from”the hospital “. That he would come later in the day that it was just a check up

He didn’t reply till after I told him I would seek legal action , his excuse for not answering was that he didn’t have his phone at the hospital (yet he text us at 6:20 am from “the hospital “ ) that he is closing down his business because of the accident and he would pay the difference if he needed to but AGAIN HE STOP RESPONDING until yesterday 8/28/2020

He send pictures of his work (which I didn’t check before making the contract ) and they are all from google

Now his solution is to charge in the new invoice$5534 keep in mind the whole job was worth $5500 for what he has done in the back yard and that he doesn’t owe me a deposit? He is not even 50% done in the back

He stated he had a license. When we made a contract and that other people use it under his name today he claim he never said he had a license but when I reminded him about what he said he now stated he does but the estimate he gave me was with out one because if not he would have charge me 10000
