My son, an Air Force veteran, began giving cash payments to "David & Amelio" towards a down payment on a car at his auto repair shop. Each week my son made payments on a generic receipt towards a 2015 Buick. No other contract or terms were provided in writing. The verbal terms were $2500.00 and you can have this car, a Buick with 130,000 miles on it and only 5 years old. After my son paid him $2500.00, the seller says, "I want $5000.00 or you can make payments to that amount." When my son had given the seller $4000.00, he says, "The final price is $12,000, and you must get insurance on the vehicle." On February 23, 2021, I contacted "Amelio" and advised him he was taking advantage of my son and increasing the price of the payments made was unethical. I advised him the price of the car verbally was $2500.00 and he has collected $4000.00. I advised him to return my sons money to him the next day as this deal didn't have a contract and he was not keeping his word. He said "Okay, honey. No problem." Today, my son returned with his receipt for a refund. Amelio tried to sell my son several other cars for $4000.00. My son said, "No." Amelio refused to refund my son the money and said, "Since you held me up, I am only going to give you $3000.00, tomorrow." I called Amelio and advised him he had no written contract with my son and that my son deserved his money back since the transaction was null and void. My son never received the car or anything the 8 weeks he paid for a car he thought he was going to drive off the lot. I contend David & Amelio used "false practices" to lure my son to a verbal contract that had has no merit. My son paid money towards a car that had no contract or terms written to confirm any agreement. Also, Amelio is not in possession of the title to sell the car. No other services were provided. If the seller had sold my son the car outright, at least my son would have the car or contract as evidence of an agreement. My son only has a nondescript receipt of payment with no information binding him to what he was paying for or how much he was paying for. I believe Amelio used the "bait and switch" practice and goaded my son into putting money on a car without the terms of a contract and increased the amount of the car at his will to keep my son paying without receipt of no goods.
