On or about December 10, 2022, approximately two weeks later, a second notice was emailed to its members stating that the studio wasn't ready to open at the new location, but business was expected to be back in full operation after Christmas, December 26, 2022, thirty days after initial closure. Additional information was given in this email that in the event the studio wasn't able to reopen, they would offer in person classes somewhere else. On December 27, 2022, Beatz Barre sent no additional communication to its members as to its status canceling in-person reservations daily, breaching its full in-person service "Icon" membership contract: C.6, "Cancellation - Facility Relocation/Closure: Membership shall be subject to cancellation and refund from Beatz Barre if we cease all business operations OR move the facility more than 15 driving miles from the current location and fail to provide, within 30 days, another facility of equal or greater value at no additional cost to the member."
On or about January 5, 2023, Beatz Barre sent an email to its members informing us they wouldn't be able to open the new location as planned because its members complained to their banking institutions that the studio closed causing them not to be able to reopen. Members were advised around this time Beatz Barre was still in operation, how refunds would or would not be handled, that not all members would receive a refund, etc. and to submit all inquires to [email protected]. As of January 9, 2023, all virtual classes, the last of their class services ceased without communication, responses to inquires, or requests for refunds answered.
