Communications with Brian Seegmiller (BS), began 7/2022 as we were looking to make some changes to our home. We followed instruction from BS and worked with a recommended Architect followed by Structural Engineer. Both recommendations were fantastic, professional, communicative and timely. We reached back out to BS 7/2023 and BS was happy to take on the job, we met in person many times, he came by our home discussed the process in depth and stated next steps were to put down a deposit once the estimate was approved and the job starts 3-4 weeks post deposit. BS was easy to get a hold of at this time, responded to communications, readily available. We received the estimate on 8/1/2023, signed it 8/5/23 and BS picked up the 10K deposit on Sunday 8/6/2023 with the understanding work would begin within 3-4 weeks as communicated, along with coordinating pick up of check BS sent texts (prior to having my money) that his team would work on our back gate for job access and organize permits. BS quickly deposited the check on 8/9/2023.

No communication for weeks, no updates, no team showing up to work on the gate, no permit submission or progress. I sent BS a text on Tuesday 9/5/23 requesting an update. BS did not respond. I sent BS an email on 9/8 requesting an update, BS did not respond to my email. Finally, 9/8/23 (over a month since depositing my check) he responds, to summarize his response it is an excuse as to his delayed response "Hi Im sorry I meant to text you back" is how it begins. There was no reference in his text about permits started, job beginning, etc.

I text him back on 9/11/23 trying to be understanding of a personal situation he shared, but also we need a start date and confirmation this is happening, responds to my text with a vague "let me see what we can do to get things started". Followed up with BS for an update on 9/12/23. 9/18/23, 9/20/23 via text, emailed 9/20 (attempt to call but VM box is full so this leads us nowhere). BS stole our money. He never had any actual intent to complete a job for me. I have asked for my money back and get vague responses "maybe in 2 weeks". I gave him a clear deadline (since he has had my money almost 2 months now) and he is now claiming to be out of town. At this point he has cost me so much time, him using me as a bank and holding my money as if it were a loan has kept it out of my account where over 2 months it would have accrued 4.8% interest ($960.00). I also took a personal loan to cover this project. I paid 1780.00 in interest on this loan before I decided to repay it in full based on BS clearly not being a professional, communicating or having any intent of completing the job the deposit was paid to do. Again, BS has stolen from me.
