Below is the letter written to Mr. Palacios after he refused to repair or replace the stackable washer/dryer my client purchased.

Product : Kenmore Gas Stackable - Extended

Warranty

Client : XXX XXXX

Mr. Palacios:

This letter is written on behalf of XXX XXXX who purchased a gas stackable washer and dryer on April 7, 2020. (See attached receipt.) He paid $350.00 for the unit, in addition to an extra $50.00 for a 3-month warranty. As you know, the unit does not work. Mr. XXXX has contacted you and followed up with you for several weeks now. However, you refuse to address the problem. Instead, you either come up with excuses that you are too "bussy" (sic) or you promise to "send them out today" or "have them call you," but never do. Mr. XXXX has had an independent technician inspect the unit, at his own expense. The technician stated the unit has a broken transmission.

Based on the foregoing, you have two options:

(1) Contact me within one (1) business day of your receipt of this letter to schedule either the repair of the unit or the delivery of a replacement unit; or

(2) Contact me within one (1) business day of your receipt of this letter and confirm that you are reimbursing the cost and sending $400.00 to this office, via overnight delivery, to be received no later than Monday, June 1, 2020.

Should you fail to do either, Mr. XXXX will be forced to initiate the appropriate legal action against you. Said complaint will include a claim for fraud and deceit based on your knowledge the unit you sold was broken and defective. There will be a request for punitive damages to punish you for taking advantage of a young, essential worker during the COVID-19 pandemic, so that you could profit from the current situation.

Govern yourself accordingly.

Purchased a fridge from them off Facebook Marketplace. Within two weeks the fridge was completely broken. They told me over the phone multiple times that they would call me back about sending over someone to repair it. Proceed to go dark. Based on their Yelp review, this has happened to dozens of people. Total scam. Do not give them a dollar of your money!
