Here is the situation from start to finish.
June 24, 2023, he came to the house, and we talked about how I wanted the gate to be like. After that he said he needed a deposit at least half to buy the material and the gate opener. So, I gave him $5000, and the agreement was that both gates should be done before my wife got back from vacation. Which Was July 3, 2023
Since then, he's been lying, excuse after excuse and has nothing done!!
July 14, 2023, I had contacted him for a follow up.
He had told me the post were ready but not the gate,
July 25 Had contacted him again & mentioned if the gate will be fully installed by July 30 Still. As we had agreed on.
He doesn’t contact me back till
July 27 saying, he had supposably broken his phone and that the gate still not ready only the post.
I had mentioned it’s been a month already. The gate should’ve been done and had asked for some pictures of the progress, and he never sent them.
He Mentioned that it was done though, and that he just dropped it off to get it powdered coated. But wouldn’t be able to reach the deadline and hadn’t even had the gate opener in his possession saying he just ordered it.
July 28, 2023, He sends me a picture of the posts powdered coated but yet no pic of the actual gate. He had come by my house saying he just got some measurements for the gate opener but the day before he said he had already ordered it.
he did provide me a picture of his driver license as well and took pictures of the truck license plate. when i looked at his driver license i seen his date of birth and asked him for how long has been doing gate work, he said for a few years, but he's business partner had 20 years of experience. he also provided me with the Adrees where they do the work. 643 Hamilton Cove Ct Tulare CA 93274
It’s now past the agreement date.
Aug 3, I told him to cancel my project and to refund me my deposit, he says it will be installed next week. Week goes by.
Aug 10, He mentions he will come by the following day (Friday) to get the install started.
Aug 11, He leaves one of his employees to get the install started and mentions the gate will be down momentarily, knowing I have my dogs in the back, so we put them inside. So, they take down my original gate and cut the concrete to install the posts. Took them all day just to install the post. So, they left me without a gate and just the two posts installed.
I end up not hearing from him, so I text him on Aug 15 saying why I haven’t I heard from you, he mentions that it supposably rain Friday after noon and Saturday.
(It didn’t) and that it already got rust. (I know rust doesn’t form that quickly even if it ever did rain)
He says “I went ahead and started a new set and looking to turn it back in Thursday and Install Monday-Tuesday. Apologize for the inconvenience”
I mention that he needs to come back and reinstall my old gate and says that he “can’t talk right now”. I tell him to have it done by Friday and he says that wouldn’t be possible and to wait till following Tuesday the 22nd. So, I said OK no excuses for not haven’t it all done on Tuesday. Monday Aug 21, He sent me a photo of a frame of a gate that wasn’t even powdered coated & didn’t even look like the one we agreed on. Tuesday rolls by and don’t hear from him. I know this is a lot of detail, but it has been causing me a lot of stress financially & mentally.
