Scammer tried to convince me that my home warranty was expiring and that I needed to renew coverage

Scammer sent mail and states that James Miller, a program Director of a warranty Division of Sandy Spring Bank, is informing me that our coverage is going to lapse in a week. There is a customer id. Upon calling the number, a lady tells me that James doesnt do this and that she will take my info. I then realized that this is a scam as then one print in the mail says they are not affiliated with my bank....

How is this legal when you say these are scams? Next steps please.

My elderly friend received this in the mail. She immediately called. They told her it would be $300 per month and she needed to sign now before she loses her house.
