T-n-T Reno's Reports & Reviews (1)

I contacted Chris Lee (TnT Renos) via his contact details he posted on Kijiji.ca to give me a quote for the construction of an attached garage to my house. Chris Lee came over to my house and after an exchange of e-mails, he gave me a final quote on the 17th of May 2016 of $20,865.00 for the construction of a two-car garage attached to my house. He stated that they would require a down-payment of $9,693 for me to be booked to start construction 2nd week of July 2016. I made a complete transfer of $9,693 to TNT renos via e-mail transfer on the 14th of July 2016 and thereby asked him for a written contract but didn't get any response from him. Sometime later an employee named Christine got in touch with my wife stating she would send all the necessary paper work but it never came. I asked him about the permit and he directed me to the city council and told me the permit is a simple process which would not take long. During the application for the city permit I discovered that the construction was too close to the property line and may be encroaching on the neighbours property. I discussed this with Chris and he promised to come and take a look at it and profer a solution. For the visit he sent a foreman and another employee named Christine who came over with nothing and had to be given papers and pen before they could come uo with a sketch. After the visit it was decided that it would be best to relocate the garage to the other side of my property where there was ample space. The hand sketched drawing on a paper was given to my wife to submit it with the application at the city council. I made a detailed archtectural sketch on my own based on what he sketched and my wife submitted this at the city council. The city inspectors came, inspected the property and granted the permit. When I informed Chris he was surprised and was insisting I send the permit to him. After I sent the permit to him, my wife would make several calls to him, he wouldn't answer and did not return my calls. He only replied sometime later giving us a lot of activities that need to be done based on the permit including a re-survey of the property and even made a remark that 'this is why he advises his clients that there are ways to circumvent the city and that he advised me too but I didn't follow his advice'. At this point knowing that the project couldn't start on time and could not be completed before the winter season I asked Chris to let us postpone the project till next year and he should give me a detailed list of any further permits and requirements to be closed out based on the contents of the permit and also submit a new quote based on the changes so that we can be better prepared for the next season. I also requested that he return the deposit with him. However, Chris only replied me stating below;

Writing in regards to the garage job recently cancelled, I have the list for you in this e-mail for the

pay out/ expenses that we paid out for your quote for all or any addition work that would have been required pending the garage job was to go ahead.

Carpenter/Lead hand: $350.00

Reserved non-refundable jack hammer: $50.00 a day

Reserved non-refundable Excavator: $300.00 an hour

Project cancelled only 3 days before start of Project: $285.00 non-refundable

Total amount/expenses: $3870.00 non-refundable

Amount owing/refunding back to customer from deposit made: $5295.00

The amount owing/refunding back to you will be held for 90 business days for any addition expenses that may be billed to T-n-T Reno's by any sub-contractor's or other expenses that we reserved for this project, we secure this hold to ensure we are not responsible for providing funds/monies for customers projects. The

refund for the sum of $5295.00 will be returned to the customer in full on February. 1st 2017 and will be paid through e-mail money transfer (EMT) the same way it was transferred to T-n-T Reno's

First of all, Chris did not provide a written contract and neither did he inform me that there will be a security holding fee of $2000 prior to me paying a deposit. As there was no contract in place, all agreements done via e-mail that may be termed a contract did not specify the terms of cancellation and I did not cancell the project but only postponed it.

Secondly, Chris claimed he spent $600 in man-hours to visit my house to re-evaluate the project, his visit lasted less than an hour with my wife providing all the that he used including the pens and papers for his sketch. He didn't provide any evidence of the calculation and just stated an arbitrary amount.

His calculations and deductions are fraudulent and designed to cheat me, even his supposed refund calculation is wrong. I paid him $9693, He claimed total amount of expenses of $3873 and his refund of $5295. Simple arithmetic calculation shows that $3873 deducted from $9693 is $5820 and not $5295 as he claimed.

At no point did he state or we agree that he will hold back my money for a period of 90 working days in any of our discussions via e-mail should in case I cancel the construction which I repeat I didn't cancel but postpone. Also, you cannot reserve equipment and personnel when you do not have the permit to start a job.

Chris considered the postponement a cancellation and decided to make frivolous charges that I consider fraudulent and unfair business practices. I am new to Canada and the province and I am sure he is taking advantage of the fact that I am new and naive to the practices and requirement in this province.

Chris and TnT renos have till date not returned any part of my money nor have they responded to e-mails and the phones are no longer workin.
